Copyright

Copyright is a legal term used to describe the rights that creators have over their literary and artistic works. Works covered by copyright range from books, music, paintings, sculpture, and films, to computer programs, databases, advertisements, maps, and technical drawings. The exhaustive lists of works which are covered by the Copyright Act 1957 (Amended in 2012) are:

  • Literary works such as novels, poems, plays, reference works, newspaper articles;
  • computer programs, databases;
  • advertisements and logos

Design

Industrial design constitutes the ornamental or aesthetic aspect of an article. An industrial design may consist of three dimensional features, such as the shape of an article, or two dimensional features, such as patterns, lines or color. The laws governing the registration and enforcement of Designs in India are provided in The Designs Act, 2000. The registered proprietor of a Design has the exclusive right to stop others from infringing his registration by making, applying the Design or importing articles bearing the Design.

Registration of designs confers significant commercial advantage on the owner. Application for registration of a design must be filed before any commercialization or public display of the article. Prior public display or commercialization can disentitle the owner

Patent

We at United & United are very well experienced in preparing and filing PCT Applications. We have had the experience of filing PCT application in India and there have been many instances wherein we successfully handled national phase PCT applications in India and outside India-

Preparing and Filing PCT International application within 12 months from the earliest priority date in the electronic mode either directly with the International Bureau or with the Indian Patent Office in Delhi or Chennai or Mumbai or Kolkata as the Receiving Office. The official PCT fees includes filing fee, international search fee, and transmittal fee, and it varies based on the nature of applicant and selection of international search authority [ISA].

Customs

1. Customs Workshop at New Customs House (IGI), New Delhi by United Overseas Trademark Company in association with L’Oreal India Pvt. Ltd.

In a very intellectually interactive platform provided by Customs authorities at the IGI customs house New Delhi, the customs interactive workshop was conducted in great success by the United Overseas trademark Company, New Delhi, in partnership with L’Oreal India Pvt Ltd. The workshop was successful in bringing forth the identification aspects of counterfeit goods in the right manner and it was intercepted successfully by the participating audience.

2. First Regional (North India)  Customs Workshop on 24.04.2012, to sensitize Custom Rules for IPR Enforcement in India.
